“Log File” Requirement Effective on August 23: Generating Over THB500-THB1,000 Million to Data-Related Business (Business Breif No.2259)

These days, we have been increasingly exposed to the computer- and Internet-related crime, either at the individual or corporate level. On July 18, 2008, Computer –Related Crime Act, B.E. 2550 thus came into force. Still, to effectively hold criminals accountable for their crimes and to give this law more bite, all ;service providers” as specified by the law will be required to install log file – regarded as a key evidence for filing lawsuits against offenders. After a one-year grace period, requirement of log file installation under the computer-related crime law will become fully effective from August 23, 2008. All agencies having computers and accessible to the Internet as specified by the law are required to install the log file system with user identification and authentication for at least 90 days. The data must be safeguarded with no access for correction or change. Those who violate the law shall be liable to a fine of not exceeding THB50,000. For those who fail to comply with the order of the competent authorities who want to access the data, they will face a fine of up to THB200,000 plus a daily fine of THB5,000 until the wrongdoing is reversed.
KASIKORN RESEARCH CENTER (KResearch) holds the view that the enforcement of this law will result in major investment in the development of log management systems. If the new computer-related crime law is strictly enforced, especially crackdowns on cyber crime, and most large business organizations become more aware of the importance of the log management systems, this may generate more than THB500-THB1,000 million in investment in the log file systems. This will represent an increase of some 7-14 percent over the overall IT expenditures in the business sector totaling some THB74.089 billion in 2007. Data-related businesses including hardware, software and services whose market turnover now standing at some THB5 billion will be the best beneficiaries.
Even though data-related business will benefit from the enforcement of the log file law, most businesses will have to bear heavier operating costs for greater investment in the log management systems. So far, the business sector has been plagued with rising costs as a result of soaring cost of fuels and raw materials as well as sluggish sales turnover amid declining consumer purchasing power. Medium-to small-sized businesses are likely to be hard hit by the surging operating costs caused by more investment in the required log file systems. In KResearch's view, to avoid these heftier costs, those small-and medium-scale businesses may opt to undertake the log management system installation themselves by purchasing ready-to-use log file programs or downloading freeware for data processing and storing in hard disks.
Knowledge and understanding of the computer-related crime law among related parties, especially small businesses is the key to effectiveness of the enforcement of this law. The government should therefore create better understanding among the general public, especially with regard to the benefits and importance of the log file systems in order to prevent possible loss and damage caused by cyber crime and to ensure effective compliance with the new law.
